PHILIPPI, W.Va. (WV News) — A 48-year-old Philippi man was indicted Monday in Barbour County on charges of kidnapping, malicious assault, possession with intent to deliver, prohibited person possessing a firearm and domestic battery, according to Prosecutor Andrew “Drew” Phillips.
Sammy Joe Martz was among 16 individuals indicted by the grand jury, with Phillips and Assistant Prosecutor Kelsey Gross presenting cases.
Judge Shawn D. Nines will preside over arraignments beginning at 9 a.m. May 31 in Barbour County Circuit Court. All defendants are presumed innocent.
Martz is accused of holding a female at his residence for four to five hours on Jan. 24. According to Philippi Police Lt. D.A. Cale, the female said Martz struck her all over her body, sat on her and burned her with a butane torch. She was eventually able to escape through a window, according to Cale. The female called police from there and waited for their arrival, according to the complaint.
Law enforcement found money, presumed drugs and a rifle hanging on a wall, according to Cale.
In addition to Philippi Police, the Barbour Sheriff’s Office and state troopers responded.
Martz remains jailed without bond.
Others indicted, and the charges against them, according to Phillips:
— Ashley Leann White, 39, Belington, child neglect creating risk of serious injury, aggravated driving under the influence.
— David Ray Montgomery, 51, Flemington, burglary, conspiracy.
— Jessie Marie Mumpire, 21, Flemington, burglary, conspiracy.
— Richard Curtis Layne, 66, Nestorville, second-offense failure to register or provide notice of change in sex offender registry information.
— Brian Edward McCord, 28, Flemington, burglary, conspiracy.
— Robert Edward Bulatko, 36, Elkins, second-offense failure to provide notice of change in sex offender registry information.
— Allen Thomas Daniels, 58, Belington, four counts failure to register as sex offender.
— Nicholas Ryan Jones, 35, Belington, malicious assault.
— Thomas Bradford Swiger, 42, Philippi, third-offense shoplifting.
— Breanna Ray Gill, 22, Belington, child neglect creating risk of serious injury.
— William Eric Miller, 34, Belington, child neglect creating risk of serious injury.
— Walter William McCord Jr., 25, Belington, uttering, conspiracy.
— Olivia Paige Mayle, 19, Coalton, conspiracy.
— Donald James Taylor, 39, Elkins, uttering, conspiracy.
— Christopher Burkhard, 52, Belington, failure to register or provide notice of change in sex offender registry information.
