West Virginia’s senior deputy solicitor general argued last week that if a jury deadlocks in a bifurcated mercy phase of a murder trial, the issue must go to a new jury.

Michael Williams also told justices of the state Supreme Court that under current West Virginia law for first-degree and felony murder, the decision must be unanimous to grant mercy, or unanimous to withhold it. And Williams also said that under current law, there would be no limit to how many times the mercy phase would be retried until a jury could reach a unanimous verdict.
